These terms govern your use of the smartPick mobile app ("smartPick", "we", "us"). By installing or using smartPick, you agree to these terms. If you do not agree, please uninstall the app.

1. Who can use smartPick

smartPick is intended solely for users aged 18 and over who are resident in the United Kingdom. The app includes an age-verification gate that you must complete before access is granted. If you are under 18, you must not use smartPick.

2. What smartPick is

smartPick is an informational app that surfaces publicly available UK National Lottery scratchcard data — such as remaining top prizes, advertised odds, return-to-player figures, and pricing — in a scannable, comparable format. It is a data transparency tool. Its purpose is to help adult consumers make informed choices about the products they are already considering.

3. What smartPick is not

• smartPick is not gambling advice. Nothing in the app is a recommendation, prediction, or promotion. No feature, score, or ordering implies that any particular scratchcard is more likely to win. Published odds remain advertised odds regardless of how the information is presented.
• smartPick is not a gambling service. You cannot buy scratchcards, claim prizes, or place bets through the app.
• smartPick is not affiliated with, endorsed by, or connected to The National Lottery or Allwyn Entertainment, nor with any retailer, regulator, or other lottery operator.
• smartPick is not a substitute for professional advice. If you are concerned about your gambling, contact GamCare or BeGambleAware.

4. Accuracy of data

The data shown in smartPick is sourced from publicly published Allwyn Entertainment information and is updated on a scheduled basis. We use reasonable care to keep it current and accurate, but we cannot guarantee it. Data may be stale, incomplete, or incorrect at any given moment — Allwyn may update their site between our scheduled refreshes, correct errors on their side, or change the format we rely on to parse it.

You should verify any figure that matters to you against the official Allwyn source before acting on it. smartPick is not liable for any decision you make based on information displayed in the app.

5. Your responsibilities

• Use smartPick lawfully and only for its intended, informational purpose.
• Do not attempt to reverse-engineer, decompile, or interfere with the app, the API, or the backend infrastructure.
• Do not attempt to automate, scrape, or abuse the backend API. Automated traffic is rate-limited and may be blocked.
• If you create an account, you are responsible for the security of the authentication provider you use (Apple, Google, or email/password). We rely on the provider's authentication signal — we do not see or store your password.

6. Intellectual property

• The smartPick app, its design, code, copy, and data presentation are owned by smartPick and are licensed to you for personal use only. You may not redistribute, republish, or offer smartPick's output as a service.
• All scratchcard names, prize structures, and brand elements remain the property of their respective owners, including The National Lottery and Allwyn Entertainment.
• If you submit any content through smartPick (for example, future diary entries once that feature is enabled), you retain ownership. You grant smartPick a non-exclusive, worldwide, royalty-free licence to store and display that content to you for the purpose of providing the service. We do not share your content with third parties except where required by law.

7. Service availability and changes

We may change, suspend, or discontinue any feature of smartPick at any time without notice. We may also stop supporting older versions of the app — if you are using a version we have retired, you may need to update to continue using smartPick. The app is provided "as is" and "as available". We do not commit to a particular uptime.

8. Limitation of liability

To the maximum extent permitted by law, smartPick, its owner, and its contributors are not liable for any loss or damage arising from:

• Decisions you make based on information displayed in the app.
• Inaccuracies or gaps in the underlying scratchcard data.
• Temporary or permanent unavailability of the app or any feature.
• Any money spent on lottery products, before, during, or after using the app.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under UK law — including liability for death or personal injury caused by negligence, or for fraud.

9. Privacy

Our handling of your personal data is governed by the smartPick Privacy Policy, which forms part of these terms by reference.

10. Governing law

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms or your use of smartPick shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page indicates when the most recent change was made. Continued use of smartPick after a change constitutes acceptance of the revised terms. Material changes will be flagged in the app where practical.
